N24bn Pension Scam: EFCC To Split Charges

The Suspect
The Economic and Financial Crimes Commission, EFCC, on Wednesday, April 22, 2015 sought the leave of the court to split the charges of conspiracy and theft of Police Pension Funds to the tune of N24bn (twenty four billion naira) brought against Esai Dangabar and six others before Justice Husseini Baba Yusuf of the Federal Capital Territory High Court, Abuja in order to ensure expeditious trial of the accused persons.

At the resumed hearing of the case today, counsel to EFCC, Rotimi Jacobs, SAN, noted with concern, the delay currently being experienced in prosecuting the case which he said, had been on since 2012.

According to him,  the case had been dragging due to large number of lawyers representing the accused persons in the matter.

Rotimi, who told the court that, he had the mandate of his client to request for the splitting of the charge said, “this matter has been on since 2012, and my Lord, the accused persons here are seven with separate counsel. We notice that because of the sheer number and representation of counsel, which must all be heard, the pace of this case has slowed down. We believe this matter can be heard by having separate trials of some of the accused. I humbly apply that my Lord allows at least three separate trials”

But Adegboyega Awomolo, SAN, counsel to the first accused,  objected stating, “the case is for continuation of trial, and we expect that the application come by way of writing so that we can confront every ground for the application”.

His argument was adopted by the other counsel.

Justice Baba Yusuf ordered the prosecution to formally file a motion for the splitting of the charge and adjourned to June 23, 2015 for hearing on the application.

It would be recalled that Dangabar alongside other accused persons: Atiku Abubakar Kigo, Ahmed Inuwa Wada, John Yakubu Yusufu, Mrs. Veronica Ulonma Onyegbula and Sani Habila Zira were first arraigned before Justice Mohammed Talba of the High Court of the Federal Capital Territory, sitting in Gudu, Abuja on a 16 count charge bordering on conspiracy and criminal breach of trust on March 29, 2012 and granted bail on April 3, 2012.

On November 12, 2012 the court dismissed the applications brought by four of the six accused persons challenging the jurisdiction of the court to entertain the case as well as the charges against them for lacking in merit.

One of the accused John Yakubu Yusuf was convicted after he opted to plead guilty.

Consequently, the prosecution filed new charges.

The six accused persons, along with  Uzoma Cyril Attang, a former chief accountant in the Police Pension office who had been elusive, took fresh pleas on an amended 20-count charge bordering on criminal breach of trust, before Justice Husseini Baba Yusuf of the High Court of the Federal Capital Territory, Abuja on April 10, 2013.

Fayose Says He Plans To Be ‘Last Man’ Standing By President Jonathan


Ekiti State Governor Ayo Fayose has promised the All Progressives Congress (APC) a torrid time in the South-West and throughout Nigeria, saying he will be playing a prominent role in that regard.

The governor made the remark in a press statement today  in which he spoke on the political crisis in Ekiti, where he faces impeachment proceedings on the same job for the second time in his political career.  

He described the APC as being sore over the fact that in all of the South-West, Ekiti was the only state they could—he said—“not "rob" for President-Elect Mohammed Buhari (rtd)”.

“I wish to declare unequivocally that I remain loyal to President Jonathan even after May 29 as my support for his re-election and administration was not about bread-and-butter,” he said.  “I was convinced he was moving Nigeria in the right direction, despite all the noise. I have no regrets supporting him. If same situation presents itself again, I would do it all over.”

He asserted that even if President Jonathan were to be deserted by all Nigerians today, he would not, as he has chosen to be Jonathan’s last-man standing.


“If for this show of loyalty to Mr President and my party, APC and its leaders believe that the best way to pay me back is to make Ekiti ungovernable, the decision on appropriate reaction belongs to the people, whose mandate I keep in trust,” he said.

Chicago Uber Driver Will NOT Face Charges For Shooting A Gunman Who Was Firing Into A Crowd


The Gunman
An Uber driver who was credited with stopping a potential mass shooting in Chicago at the weekend by pulling out his own personal firearm and shooting the would-be gunman will not face any charges for his actions, a court has decided.

Prosecutors say the driver with a concealed carry permit shot a 22-year-old man who opened fire on a group of pedestrians in Logan Square.

The bullets hit him in the legs and lower back, according to reports.
The man was taken to a local hospital for treatment. The incident occurred about 11.50pm and there were no other injuries.  

However Assistant State’s Attorney Barry Quinn says the driver, who has a firearm owner’s identification card, acted in self-defense and the defense of others.

The driver is not facing charges.

Court records say the man, identified as Everardo Custodio, shot at people walking in front of the driver’s vehicle on Friday night in the busy neighborhood

Police have not yet released a motive for Everado's shooting.

He’s facing charges of aggravated battery with a firearm and illegal possession of a firearm.

17-Year Marriage Ends In Three Dead When Husband Catches Wife Meeting Lover At Hotel


Alyce Alsup remembers having a nice visit with her daughter Shaquana Graham, 33, and her three kids on Saturday. Little did she know, that it would be the last time she would see her daughter alive.

Graham thought she had dropped her husband Donnell, 35, off at the airport to go on a business trip. But he was outside, waiting for his wife of 17 years to follow through on what he suspected was a clandestine hook up with another man.

The next morning, police came to Alsup’s house to tell her that her daughter was dead, murdered by her husband after he caught her with another man at a Quality Inn in Central Pennsylvania. Donnell Graham had then turned the gun on himself.

The other man, Kristopher Pittman, 25, was shot in the chest, and Shaquana was shot in the head.

The person in the next room said he heard five gunshots, one after another, then three more before silence. Police were called and they found the bloody scene.

Police are calling it a double homicide and suicide.

Alsup told ABC News that she was not aware that the couple was having any problems.

The Grahams reportedly were high school sweethearts that married when she was 16 and he was 18. They leave behind a 17-year-old son and twin 13-year-old girls.

17-Year-Old Daughter Of Emir Of Katsina Dies In India

The Emir of Katsina state, Alhaji Abdulmumini Kabir Usman, has suffered a major loss.

His daughter.  Zainab Abdulmumini Kabir died in an Indian hospital few days ago after a brief illness at the age of 17 and has been buried according to Islamic rites.

Cops Hunt Papparazzi Who Took Pictures Of Bruce Jenner In A Dress


The paps who took pictures of Bruce Jenner in a dress are being hunted for. According to TMZ ,what they did was illegal.   L.A. County Sheriff's deputies paid a visit to Bruce Jenner's Malibu house Tuesday,  then went on the hunt for the paparazzi who have been perched on a nearby hillside and taking aim with telephoto lenses. It's illegal for photogs to use telephoto lenses to invade the private spaces of the people they're shooting.

The photographers took pics of Jenner earlier in the day that were being peddled around town. They've also taken pics over the last week from the same perch and Bruce has confronted them. He said he would call the cops if they came back. Tuesday Bruce made good on his promise.


Bruce could, if he wants, probably get a restraining order against the photographers. He could sue them as well.

Demi Lovato has been very open about her rehab treatment for drugs, alcoholism, self-harming and bulimia in 2010 and has revealed boyfriend, Wilmer Valderrama, refused to ‘enable’ her behavior when they were together at the time.

Fake Army Officer Arrested In Enugu For Alleged Rape


A man who has been parading himself as a senior army officer in the Amaja community in Igbo-Eze North Local Council of Enugu State, causing havoc and terrorising the people as well as raping young girls in the area, has been arrested by the state Police Command.

Identified as Felix James, the fake army officer was said to be playing on the ignorance of the people and their fear of the military to intimidate them, walking about freely as a genuine army officer until he was nabbed by detectives from the Nsukka Command who had been trailing him for a long time, pulse.ng reported.

The fake officer, in his confession to the police after his arrest, said he had tried several times to be enlisted in the Nigerian army without success, adding that he procured the uniform and camouflages through the help of one of his friends.

Hear him: “My friend Regean Igbonekwu, whose father was a retired soldier, gave me the army uniform to wear to convince my parents that I had successfully joined the Nigerian Army.

I came back in November 2014 with the army uniform and since then till now, I have never worn the uniform again. I paid Reggan a total sum of N80, 000 for the army uniforms he supplied to me.”

The suspect added that he was selling cosmetic products in Kogi State before he decided to join the army and failed, explaining that he left secondary school in 2012 and took the army recruitment examination for two consecutive times without success.


“Everybody in the community knew that I went for the army recruitment but they didn’t know that I was not successful. I am a married man with one child and my wife even thinks I am an army officer.”

US Drug Enforcement Head Retires After Sex Scandal


The head of the US Drug Enforcement Administration is retiring, an official said Tuesday, following a scandal involving drug agents attending orgies with cartel-hired prostitutes abroad.

Michele Leonhart, head of the anti-drug trafficking law enforcement agency, is retiring in mid-May, Attorney General Eric Holder said in a statement.

Holder hailed Leonhart’s achievements as a law enforcer and her leadership of the DEA since 2007.

“As the first woman ever to reach the rank of Special Agent in Charge, she was a trailblazer for equality and an inspiration to countless others,” Holder wrote.

The DEA came under intense criticism following a Justice Department report at the end of March that found agents attended orgies with prostitutes they should have known were hired by a drug cartel.

The sex parties reportedly took place in Colombia.

Agents attended the parties hosted at government-leased headquarters over the course of several years, the report said.

Seven of 10 officers who were accused of taking part in the parties confessed and were disciplined.

The report into the behavior of federal agents was commissioned after a scandal in the US Secret Service saw agents there hire prostitutes in Cartagena, Colombia ahead of a presidential visit.

The scandal prompted congressional hearings by irate lawmakers.

Holder sent a note to the Justice Department’s 113,000 employees earlier this month reminding them not to consort with prostitutes.

How Indian Perpetrated N32b Bank Fraud, By EFCC



The Federal High Court in Lagos yesterday heard how an Indian businessman, Patrick Fernandez, allegedly perpetrated a N32billion bank fraud.

Fernandez, along with three of his companies, is facing a 56-count charge of fraud. A former Economic and Financial Crimes Commission (EFCC) investigator, Bashir Abdullahi, said the commission learned of the fraud when one of the banks contacted the agency’s Financial Intelligence Unit.

According to him, in July 2008, he was assigned to investigate the case of suspicious financial activities involving Fernandez and his companies. The banks, he said, are Zenith, Afribank, Intercontinental, Union and Wema.

His investigations, he said, revealed high volume transactions from one account to another, which he said were suspected to be fraudulent. Abdullahi said: “Our findings was that he was involved in cheque-kitting and round tripping. It is also known as Lazy Susan, a business model.” Lazy Susan, he said, involves members of a business group transferring money from one sister company to another without selling any commodity, using money obtained from other banks.

He said as, at September 2007, the accused had less than N2million in his account. “The volume of transaction was also minimal, starting with N20million. Within the same month, it rose to N600million. The volume of transaction also sky-rocketed to billions of naira within just three months,” he said. Abdullahi said the transactions involved the use of “suspended cheques” which did not go through the clearing house initially. “If he brings a cheque, credit will be given to him immediately without going through clearance. Because he has a cheque discounting facility, if he brings N1billion cheque, they will give him N800million,” Abdullahi said.

He said Wema Bank, for instance, discovered that it allegedly lost N23billion to the activities of Fernandez and his companies.

On how the fraud was perpetrated, he said a high ranking staff of Wema Bank aided the fraudulent transactions. The Wema Bank insider, the witness said, “was suppressing the cheque”, such that when other banks asked whether there is money in Fernandez’s account, the official would answer in the affirmative. “All the banks will ask Wema Bank staff: ‘Is there N5billion in his account, and he will’say yes,” said the witness.

Abdullahi said the accused person claimed to be involved in oil and gas business which he said was “cash-intensive” and therefore needed to move money from one bank to the other. He said the bubble burst when the banks, at the clearing house, discovered that “they were clearing the same cheque”.

Under cross examination by defence counsel, Mr James Ocholi (SAN), Abdullahi said he did not know the banks’ account officers or branch managers who dealt with Fernandez. He said the defendant’s companies were duly incorporated, and that his accounts were opened through “traditional” means. He added that Fernandez was considered high net-worth individual and so the banks took him for his words. “If they had not taken him for his words, we won't be talking about missing billions. The accused person stated that a point, he became the darling of the banks,” the witness said.

He said the investigation was triggered by a Suspicious Transaction Alert received from Afribank.
“They reduced the complaint to an intelligence and forwarded to EFCC operatives for investigation. I don't know if there was a petition,” Abdullahi said.

Justice John Tsoho adjourned hearing till June 16 for continuation of trial.

Suleiman Hashimu, also called ‘the traveller’, no doubt has set a historical record as the first man to trek from Lagos to Abuja.

In a new interview with newsmen,  the Traveller, a native of Katsina State, talked about his more than 2 weeks journey.

According to Hashimu, he was in Lagos when Buhari was announced the president-elect of Nigeria, so he left Lagos at about 5am the next day and arrived in Ibadan around 6pm.

Narrating his ordeal to newsmen upon his arrival in Abuja, Hashimu said he had gone to get a police report at Ibadan to allow for an unimpeded journey, but that as he could not wait for the processes to be completed, the divisional police officer (DPO) gave him his phone number.

Hashimu said when he first embarked on the journey, many persons discouraged him, especially family members but he never gave up.

He told journalists that in Ilorin, people accompanied him for several miles until he stopped at Oloru, where he received much hospitality in Jebba. He said unlike other villages, he met people who had heard of him in Jebba.

Hashimu further explained that about 20 people set off with him from Jebba and after some miles, 18 turned back, but the other two who were more strong-minded followed him.

The Traveller narrated how they encountered armed robbers close to Mokwa, but fortunately for him, he had already met one of them in Jebba and the would-be robber ended up giving him N200 for ‘pure’ (sachet) water.

Hashimu said he continued his trip from Mokwa to Kudu, then from Kutigi to Bida, and then to Suleja, after which he arrived in Abuja on Monday, April 20, 2015.

Upon his arrival in Abuja, many residents were already waiting to receive him. When residents of FCT saw him, the chorus of Sai Buhari rented the air.

Reports stated that Hashimu yesterday received a horse as a gift from the Agora Of Zuba, HRH Mohammed Bello Umar.

Why Jonathan Fired IGP, Suleiman Abba


The Inspector-General of Police, Mr Suleiman Abba, yesterday, became the first major casualty of the just concluded general elections, which President Goodluck Jonathan and his party, the People’s Democratic Party, PDP, lost to the opposition.

The police officer, who was elevated to the post only last year, incurred the wrath of the Presidency on the eve of the governorship and House of Assembly elections for allegedly arguing with the government officials over the directive to recall the Assistant Inspector-General of Police in Charge of Zone 6, Tunde Ogunshakin, from Rivers State.

Abba, it was learnt, had deployed Ogunshakin from his base in Calabar to Port Harcourt to oversee the governorship election in Rivers State following complaints by Governor Rotimi Amaechi of Rivers State, that the police had collaborated with the Independent National Electoral Commission, INEC, and the PDP to intimidate APC members and rig the presidential and National Assembly elections in the state.

Another source said the former police boss reportedly ignored presidency official’s objection to the deployment of Ogunshakin to Rivers State on the allegation that the police officer was sympathetic to Amaechi and his party and would, therefore, not allow the PDP win the state.

A Presidency source told Vanguard that on learning that the IG had defied its order by redeploying Ogunshakin to Rivers State to supervise the governorship elections. A presidency official called the former police boss to recall the AIG with immediate effect from Rivers State or face the consequences. The source said the presidency felt slighted when it could not get through to Abba.

The former police boss reportedly told the Presidency that AIG Ogunshakin was a formidable Police officer whom he described as a ‘no-nonsense officer’ feared and respected in the Police Force hierarchy and capable of ensuring law and order in the place of new assignment.

Vanguard learnt that although the sacked IG reluctantly recalled Ogunshakin from Rivers State, forcing him to quit Port Harcourt by 5 am on the election day, Presidency did not forgive Abba for redeploying Ogunshakin reluctantly.

Another sin of the former IG was his presence at the presentation of the Certificate of Return to Muhammadu Buhari at the International Conference Centre on April 1, 2015, which convinced the Presidency that the IG was actually working for the opposition and it moved quickly against him.

The Senior Special Adviser to the President on Public Affairs, Dr. Doyin Okupe, could not also be reached for comments on the development.

Abba’s sack was announced by the president’s spokesman, Reuben Abati, in a statement yesterday. No reason was given for the sack while a Deputy Inspector-General of Police, Solomon Arase, was appointed to act in his stead.

Abati’s statement read in full: “President Goodluck Jonathan has relieved the Inspector-General of Police, Mr. Suleiman Abba, of his appointment and duties with immediate effect.

“President Jonathan has also appointed Deputy Inspector-General of Police, Mr. Solomon Arase, as Acting Inspector-General of Police, also with immediate effect.

“Until his appointment as Mr. Abba’s replacement, Mr. Arase was the Head of the Force Criminal Intelligence and Investigation Department.

“Mr. Arase holds Bachelors and Masters degrees in Law, as well as Bachelors and Masters degrees in Political Science and Strategic Studies.

“He is also a Fellow of the Nigerian Defence College.”

Mr. Abba, 56, became acting Inspector General on August 1, 2014 following the retirement of his predecessor, Mohammed Abubakar, after 35 years of public service.

He was confirmed substantive IGP on November 4, 2014.

Abba was, until that appointment, an Assistant Inspector General, AIG, in charge of Zone 7 Command, a position he occupied since May 25, 2012. He was also an Aide-De-Camp, ADC, to the wife of a former military Head of State, Maryam Abacha.

With his removal, Mr. Abba will proceed on forced retirement, four years before he attains retirement age.

He enlisted in the Nigeria Police as Cadet Inspector on December 31, 1984 and is actually due for retirement on March 22, 2019.


Carpenter Stabbed To Death While Separating Fighting Co-Tenants

A carpenter, Kunle Abiola, has been stabbed to death in the Ajegunle area of Lagos while trying to separate his co-tenants, who were fighting.

PUNCH Metro learnt that Abiola was stabbed to death by one of the co-tenants, identified as Nweke Chinonso.

It was gathered that Abiola and Chinonso both lived on Mba Street in the area.

Chinonso, who had been arrested by policemen from the Ajegunle Police Division, allegedly stabbed Abiola with a kitchen knife in the jaw and in the chest.

Our correspondent learnt that on Sunday, April 19, the suspect had an argument with a woman in the apartment, whose name had yet to be known.
  
It was gathered that the argument, which degenerated into a fight, brought Abiola to the scene.

The deceased reportedly tried to separate the two fighters, during which Chinonso got a knife and stabbed him to death.

A resident of the area, identified simply as Ibrahim, who claimed to be an eyewitness, said some people rushed Abiola to a general hospital, adding that he did not survive the stabbing.

He said, “The two people who were fighting are also neighbours. It was just a minor argument which resulted into a physical fight. Abiola came by and tried to separate them. He particularly held Chinonso, pleading with him to take things calmly.

“Chinonso managed to get a kitchen knife. He stabbed Abiola and the man slumped.

“When the police were called to the scene, all of us rushed the man to the general hospital in Awodiora, Ajegunle, but the doctors on duty confirmed him dead.

“The police then took his corpse to the station. We all shed tears; Abiola was a good man.”

Our correspondent learnt that Chinonso told the police in his statement that it was the devil that pushed him to commit the act.

A police source at the division said Abiola was well known to the division as he had done some carpentry works for the police in the past.

“We knew the victim very well. He usually worked for us at the station. He was very friendly and we never heard that he quarrelled with anyone. It was just unfortunate that he fell prey to an aggressive man. The suspect will be made to face the music,” he said.

The Lagos State Police Public Relations Officer, DSP Kenneth Nwosu, confirmed the incident. He added that Chinonso had been transferred to the State Department of Criminal Investigations where further investigations were ongoing on the matter.

He said, “The suspect stabbed Abiola in the chest and he was rushed to the hospital where he was confirmed dead. The matter has been transferred to the SCID.”
